The following General Terms and Conditions of Sale govern the offer and sale of products on our website mirtylla.com. Please read these terms and conditions carefully before ordering any products. You should understand that by ordering any of our products, you agree to be bound by Terms and Conditions of Sale as well as the Privacy Policy and Additional Legal Notes.

 

The products purchased on mirtylla.com are directly sold by MIRTYLLA S.n.c. di Paparella A. e Bianchi M (hereinafter referred to as "the Vendor" or "We" or "Us") with registered office in Italy at Via Pace, 17 – 22074 Lomazzo (CO), VAT number/Tax Code 03627580131 - REA n. 324585.

1.How to Execute a Contract with the Vendor

To place an order for the purchase of one or more products on mirtylla.com, you must be over 18; you have to completed all the obbligatory fields in the order form and the send it electronically to the Vendor, following the relevant instructions. Once you have process the order you will be register on the site mirtylla.com, you will have your account My Mirtylla, where you can enter using your personal and confidential login and password, to use all Mirtilla services.

The order form contains a summary of these General Terms and Conditions of Sale, information on the main characteristics of each product ordered and corresponding unit price, the type of payment that you may use in order to purchase each product, shipping terms and delivery costs for the purchased products.

An order shall be deemed to have been submitted when the Vendor receives your order form electronically.

1.4
Before submitting your order form for the purchase of products, you will be asked to carefully read the General Terms and Conditions of Sale, to print a copy using the print option and to save or reproduce a copy thereof for your own personal use.

The order form will be filed in our data base for the time required to process your order and as provided by law. You may access your order form by clicking on the section called My Mirtylla.

Before submitting the order form, you will be asked to identify and correct possible input errors.

English is the language used for executing contracts with the Vendor.

After your order form has been submitted, the Vendor will process your order.

The Vendor may not process purchases when orders are incomplete or incorrect, or the products are no longer available. In the above cases, we shall inform you by e-mail that the contract has not been executed and that the Vendor has not carried out your purchase order specifying the reasons thereof. If the products displayed on mirtylla.com are no longer available at the time of your last access and once the Vendor has received your order form, the Vendor shall inform you with urgent of the unavailability of the ordered products. If the order form has been sent and the price has been paid for items that are no longer available, the Vendor will refund the amount paid for those items.

By submitting an order form to and making a contract with the Vendor, you unconditionally accept and undertake to observe the provisions of these General Terms and Conditions of Sale. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on mirtylla.com.

By submitting an order form, you agree and accept these General Terms and Conditions of Sale as well as further conditions contained on mirtylla.com, even through links, including the Privacy Policy and the Additional Legal Notes.

Upon submission of an order form, the Vendor shall send you a purchase order receipt e-mail, containing a summary of the information related to the order form (General Terms and Conditions of Sale, the products' main characteristics, detailed information on the price, terms of payment and shipping costs).


2.Guarantees and Product Price Indication

On mirtylla.com, we only offer products Made in Italy, marked with the "Mirtylla" trademark.

2.2
The Vendor does not sell second-hand products, flawed products or products of lower quality than the corresponding market standards.

2.3
The main characteristics of products are shown on mirtylla.com on each product page. The products offered for sale on mirtylla.com may not exactly correspond to the real garments in terms of image and colours due to the Internet browser or monitor used.

2.4
Where applicable, the price shown is inclusive of VAT. Delivery costs will instead be added separately. Prices are subject to change and will be as quoted on our site from time to time, except in cases of obvious error. Check the final price of sale before sending the relevant order form.

2.5

The Vendor, in case of exercise your return right, has the right not to accept returned products that have been altered from their original status or have been damaged.


3.Payments
3.1
Payment of the product prices and relevant costs for shipping must be made by using one of the procedures indicated on the Payment area and shown on the order form.

If you pay online through Credit Card System or Pay-Pal, your financial data will not be shared with mirtylla.com but will be handled directly by the Payment Gateway or PayPal. PayPal and Credit Card Gateway protects your privacy and your financial and personal information using advanced encryption systems automatically.

 


4. Shipping and Delivery of the Products
For specific shipping and delivery procedures see the Shipping area. Please read these sections carefully. The information provided in these sections forms an integral part of these General Terms and Conditions of Sale and, consequently, shall be deemed to be fully read and accepted by you at the time your order form is sent.

6. Changes and Returns

-ALWAYS TRY ON THE ITMES WITHOUT REMOVING YOUR UNDERWEAR. DIRTY ITEMS WILL NOT BE REFUNDED.


-THE USE OF THE ITEMS AT WELLNESS AND THERMAL CENTERS IS STRONGLY NOT RECOMMENDED; SUBSTANCES AND TREATMENTS AT THESE CENTERS CAN DAMAGE THE ITEMS PERMANENTLY (discolor the fabric, blacken accessories, etc.). ITEMS DAMAGED BY USE AT THERMAL CENTERS WILL NOT BE REFUNDED.


6.1
You may change sizes or models by notifying the Vendor in writing within fourteen (14) working days, beginning with the day after you received the products.

6.2
Download Changes and Return Form in which You will find all information.

6.3
To return products you must use a own trusted courier.The shipping costs for returning the purchased products will be at your expense. Any customs duties will be at your expense.


6.4
Canges will be accepted if:
•you should send a copy of the Changes ad Return Return Form togheter with the returned products;
•the products should not have been used, worn, washed or damaged;
•the identification tag should be return with the products;
•the products should be returned in their original packaging;
•products should be returned to the Vendor within fourteen (14) working days from the date you sent by e-mail the Retur Form to the Vendor.



7. Consumer Rights and the Cooling-Off Period
7.1
You may cancel your contract with the Vendor in relation to products purchased, without any penalty and without specifying the reason, by notifying the Vendor in writing within fourteen (14) working days, beginning with the day after you received the products. 

 

7.2

To notify to us the cancellation of the contract you have to compleate the Changes and Return Form

 

7.3
You should return the products to the Vendor within fourteen (14) working days from the date you sent the Retur Form to the Vendor, in the same condition in which you received them and at your own expense. You have a legal obligation to take reasonable care of the products whilst they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

 

7.4

To return products you must use a own trusted courier. You will be responsible for the cost of returning the products to us and you are responsible for loss or damage to products during the transport.

7.5
To return the products, addition to complyingthe terms and conditions described in paragraphs 6.1, 6.2, 6.3 e 6.4:
•you should send a copy of the Changes and Return Form togheter with the returned products;

•the products should not have been used, worn, washed or damaged;
•the identification tag should be return with the products;
•the products should be returned in their original packaging;
•products should be returned to the Vendor within fourteen (14) working days from the date you sent by e-mail the Retur Form to the Vendor.



8. Time andmethods of reimbursement

 

8.1

If the return right is exercised in conformity with the procedures and time limits specified in paragraph 6 above, the Vendor will refund the sums paid for the purchase of products (excluding shipping costs) in accordance with the procedures and deadlines below .

 

8.2
After returning products, the Vendor check the conformity of the terms and conditions set out in paragraph 7 and, if the checks are successfully concluded, the Vendor will send you by e-mail, its confirmation of acceptance of returned products.

 

8.3
Afterthesuccessful completion of thesechecks the Vendor will refund the sums paid. In this case, we will usually process any refund due to you as soon as possible and, in any event, within thirty (30) days of the day we confirm to you by e-mail that you are entitled to a refund the costs of the producst you paied.

In the event that you do not comply with the procedures and time limits for exercising the right of return, as specified in paragraph 6 above, we will not be entitled to reimburse the sums paid. In this case, you will be notified that the returned products cannot be accepted and you may elect to have the products re-delivered to you, at your own costs. If you do not accept re-delivery of the products the Vendor reserve the right to retain the products and the purchase price.


8.4
If the recipient of the products indicated in the order form is different from the individual who made the payment for such products, the amount paid for returned items shall be refunded by the Vendor to the individual who made the payment.

8.5
the Vendor will refund the price of the products in accordance with the applicable time frame as specified in clause 6 or 7 above. The Vendor shall not be responsible for any delay that is beyond its control including delay caused by Credit Card/Debit Card companies refund policies.

9. Products Not Compliance to the Order

 

9.1
In the event the products delivered were not in compliance as specified in the order form (model, size or color) you have the right to request a replacement of products within fourteen (14) working days from the date of receipt of products; contact the vendor at info@mirtylla.com and you will be given all the information necessary.


9.2

To notify to us the request the replacement of the products you have to compleate the Changes and Return Form 

9.3
You should return the products to the Vendor within fourteen (14) working days from the date of receipt of products.

 

9.4

To return the products, in addition to complyingthe terms and conditions above:


• you should send a copy of the Changes and Return Form togheter with the products to bereplaced;

• the products should not have been used, worn, washed or damaged;
• the identification tag should be return with the products;
• the products should be returned in their original packaging;
• remember that the products must be delivered to our courier within fourteen (14) working days from the date of receipt of products.


9.5
After returning products, the Vendor check the conformity of the terms and conditions described in paragraphs 8.1, 8.2, 8.3 e 8.4 and, if the checks are successfully concluded, the Vendor will send you by e-mail, its confirmation of acceptance of returned products.

 

9.6
Afterthesuccessful completion of thesechecks the Vendor will send you the correct products within fourten (14) days from the date on which the Vendor confirmed you by e-mail the acceptance of return item.

In the event that you do not comply with the procedures and time limits to to request the replacement of the products, as specified in inthis paragraph 8, you will not be entitled to the replacement of the product. In this case, you will be notified that the returned products cannot be accepted and you may decide to have the products re-delivered to you, at your own costs. If you do not accept re-delivery of the products the Vendor reserve the right to retain the products and the purchase price.

 


10. Governing Law
These General Terms and Conditions of Sale are governed by Italian law and in particular by Italian legislative decree no. 206 of 6 September 2005 on distance contracts and by Italian legislative decree no. 70 of 9 April 2003 on certain aspects related to e-commerce.


11. Amendments and updates
The General Terms and Conditions of Sale The General Conditions of Sale may be modified and updated for internal reasons or in consideration of new laws and regulations. The new General Terms and Conditions of Sale shall be effective as of the date of publication on mirtylla.com.
